TERMS OF SERVICE AND SALE – CANADA
These Terms of Service and Sale (the "Terms") constitute an agreement between:
L'Origine Cachée Inc., a company incorporated under Canadian law, Business Number (BN): 1180998230, with its registered office at 15856 Rue Victoria, Montréal QC H1A 0A9, Canada, operating under the trade name HushLab (hereinafter "www.hushlab.ca"),
and any person browsing and/or making a purchase on www.hushlab.ca, hereinafter referred to as the "User."
Any purchase or visit to www.hushlab.ca (the "Site") automatically constitutes acceptance of the entirety of these Terms of Service and Sale, available at: https://hushlab.ca/policies/terms-of-service
Definitions
Customer: any User who holds an account on the Site and/or makes a purchase of a Product through the Site.
Order: the process by which the Customer selects Products and completes payment.
Product: any item available for purchase on the Site.
User: any person accessing the Site, whether or not they are a Customer.
Site: all web pages of www.hushlab.ca.
Article 1 – Purpose and Scope
These Terms define the conditions under which Users may access and use the Site. Users agree to comply with all conditions, policies, and terms described herein. Any visit or purchase on the Site constitutes unconditional acceptance of these Terms.
Article 2 – Current Version
The applicable version of these Terms is the one available on the Site at the time of the Order. HushLab may update these Terms at any time to comply with Canadian law or for technical reasons. Users should regularly review the Terms at: https://hushlab.ca/policies/terms-of-service. Continued access to the Site following any update constitutes acceptance of the revised Terms.
Article 3 – Conditions of Use
The Site is hosted on Shopify Inc., an e-commerce platform provider. The User confirms they have reached the legal age of majority in Canada. The User agrees not to use the Site or its services in any unlawful or unauthorized manner. HushLab is not liable for interruptions to the Site or its content.
Article 4 – General Conditions
HushLab may refuse access to its services to any person or limit sales in certain areas. Product descriptions, prices, and availability may be changed at any time. Any offer is void where prohibited by Canadian law.
Article 5 – Pricing
Prices are displayed in Canadian dollars (CAD) before taxes. Applicable taxes (GST/QST) will be calculated and added at checkout. Prices applicable are those displayed at the time of the Order. Prices may be adjusted based on logistics or raw material costs.
Article 6 – Product Presentation
Product photographs are provided for illustrative purposes only. Colors and details may vary depending on screen display and are not guaranteed to be identical to the images shown. HushLab does not guarantee that all Products will meet the User's expectations.
Article 7 – Optional Tools and Third-Party Links
Certain third-party tools or content may be accessible through the Site. The User uses these tools at their own risk and must comply with the terms of the relevant third-party providers. HushLab disclaims any liability related to the use of such tools or content.
Article 8 – Comments, Suggestions, and Other Submissions
Any comment, suggestion, or idea submitted to the Site may be freely used by HushLab without obligation of compensation or confidentiality. The User is responsible for their comments and must respect the rights of others.
Article 9 – Personal Information
Personal information is processed in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and our Privacy Policy, available at: https://hushlab.ca/policies/privacy-policy
Article 10 – Orders
An Order is finalized upon full payment and email confirmation. Orders may only be cancelled in the event of stock shortage or force majeure. The Customer is responsible for tracking their Order using the tracking number provided by email.
Article 11 – Delivery, Exchange, and Returns
Shipping fees are indicated at checkout. Delivery times depend on carriers and may vary. Defective or non-conforming Products may be returned in accordance with Canadian law. Products must be returned in their original condition for any refund. (See our full Return & Refund Policy for details.)
Article 12 – Limitation of Liability and Warranties
HushLab disclaims any liability arising from improper use of the Site or its Products. Products are provided "as is," and the User assumes all risks associated with their use. Canadian statutory warranties apply to hidden defects and product conformity.
Article 13 – Indemnification
The User agrees to indemnify HushLab for any third-party claim arising from a violation of these Terms.
Article 14 – Severability
If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.
Article 15 – Termination
HushLab may terminate access to the Site in the event of non-compliance with these Terms. Obligations arising prior to termination shall remain in effect.
Article 16 – No Waiver
The failure to exercise any right under these Terms does not constitute a waiver of that right.
Article 17 – Governing Law
These Terms are governed by the laws of the Province of Quebec, Canada, and any dispute shall be subject to the exclusive jurisdiction of the competent courts of the judicial district of Montreal.
